Pesticide product authorisation in the European Union

In the European Union a plant protection product must be authorised in the Member State where it is placed on the market or used. Approval of the active substance happens at EU level; authorisation of the finished product is granted nationally. The EU Pesticides Database records active-substance approval status and authorisations reported by Member States.

    Regulation (EC) No 1107/2009, Article 28(1) provides that a plant protection product “shall not be placed on the market or used unless it has been authorised in the Member State concerned in accordance with this Regulation”.

    Documented exceptions

    • Article 28(2) sets out derogations, including products containing exclusively basic substances, use for research or development under Article 54, and production, storage or movement of a product intended for use in another Member State where it is authorised there.
